Revived EU constitution

In his article today on the CBI's warning regarding the revived EU Constitution, Ambrose Evans-Pritchard quotes the old Labour line about the Charter of Fundamental Rights "having no more legal force than the Beano". If only that were true. The fact is that it is cross-referenced in legislation in the European parliament (as is the Constitution as a whole), and it is called in aid by the European Court of Justice, and is thus incorporated piecemeal into European jurisprudence via case law and precedent.
To an alarming extent the EU institutions are treating both the Charter, and the Constitution, as if they were established in the EU treaties -- demonstrating yet again the EU's contempt for democracy and the rule of law.
